Terms of Service

You must be at least 18 years old and at least the age of legal majority where you live to use the Services. You must provide accurate information and have legal capacity to enter into these Terms. When an administrator creates or manages an account for an organization, that administrator may control access for the organization’s authorized users.

Brambles provides AI chat, AI search, product discovery, content indexing, commerce, monetization, analytics, dashboards, APIs, and related integration tools for publishers, brands, retailers, and other authorized customers. Available features and limits depend on the plan or written agreement that applies to your account.

The Services may surface products, offers, advertisements, sponsored content, affiliate links, or other information supplied by third parties. Unless a separate written agreement expressly says otherwise, Brambles is not the seller of third-party products and is not a party to a transaction between an end user and a merchant.

You are responsible for activity under your account and for limiting access to authorized users. Keep account credentials secure and follow our documentation when using API keys. Safeguard secret credentials, do not share them outside your authorized team, rotate them when appropriate, and promptly notify us if you suspect compromise or unauthorized use.

You may not use another customer’s credentials or misrepresent who you are. We may require credential rotation or take reasonable steps to protect the Services and other customers if we identify a security risk.

Brambles and its licensors own the Services, including their software, designs, documentation, trademarks, and related intellectual property. Subject to these Terms, your plan limits, and payment of applicable fees, Brambles grants you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes and on websites, stores, applications, or other properties you own or control.

You may not copy, rent, sell, sublicense, resell, or commercially exploit the Services except as expressly allowed by your plan or a separate written agreement. You may not remove ownership notices, bypass usage controls, or reverse engineer the Services except to the limited extent applicable law does not allow that restriction.

If you voluntarily provide feedback, you allow Brambles to use it without restriction or payment, but you do not transfer ownership of your separate content or confidential information by providing feedback.

You retain ownership of content and data you submit to the Services (“Customer Content”). You grant Brambles a limited right to host, copy, process, transmit, display, and modify Customer Content only as reasonably necessary to provide, support, secure, and improve the Services or follow your instructions. This permission ends when the relevant content is deleted from our systems, subject to reasonable backup retention and legal obligations.

Brambles does not use Customer Content to train AI models unless you separately agree in writing. You are responsible for having the rights, notices, and consents needed for the Customer Content you provide and for configuring your use of the Services in compliance with applicable law.

AI-generated responses, recommendations, summaries, and product matches may be incomplete, outdated, or inaccurate. You are responsible for reviewing outputs before relying on, publishing, or acting on them. The Services are not a substitute for legal, medical, financial, or other professional advice.

Product prices, availability, shipping, returns, warranties, and merchant policies are controlled by third parties and may change without notice. Purchases and disputes about third-party products are governed by the merchant’s terms. Brambles or a participating publisher may receive compensation from affiliate, sponsored, advertising, or other commercial placements.

You may not use the Services to:

• break the law, violate another person’s rights, or facilitate fraud or deception;
• upload malware, harmful code, or content you do not have the right to use;
• gain unauthorized access, probe security without written permission, or interfere with the Services or another customer;
• scrape, harvest, or extract data at scale except through an authorized feature or API;
• bypass plan limits, access controls, rate limits, or safety measures;
• impersonate others, send spam, or create abusive or misleading experiences; or
• use outputs for high-impact decisions about a person without appropriate human review and a lawful basis.

Plan features, usage limits, prices, trial terms, overage charges, and other commercial terms are shown when you purchase or in a written order form. The specific commercial terms you accept at purchase are part of these Terms. General pricing may change, but a change will not retroactively alter a paid billing period. You authorize Brambles and its payment processors to charge your selected payment method for applicable fees and taxes.

Paid subscriptions renew automatically for the same billing period unless you cancel before renewal. If a trial is described as converting to a paid plan, the applicable fee is charged when the trial ends unless you cancel first. Some plans may be offered without a subscription fee but can still have usage, monetization, or other plan-specific terms.

You may cancel through the billing controls made available to your account or by contacting us. Unless the purchase terms say otherwise, cancellation stops future renewals and paid access continues through the end of the current billing period. Fees already paid are non-refundable except where required by law or expressly stated at the time of purchase or in a separate written agreement.

If you use the Services on a website, application, or platform as a publisher, you are responsible for that property and for disclosures, notices, and consents required for affiliate links, sponsored content, advertising, cookies, and similar monetization.

Your applicable plan, dashboard, or written agreement states the revenue share, payout schedule, minimum threshold, clearance period, and eligible revenue sources. Publisher earnings become payable only after Brambles receives and reconciles cleared funds from the relevant merchant, affiliate network, advertiser, or payment provider.

We may adjust, delay, offset, or withhold amounts reasonably connected to invalid traffic, fraud, returns, reversals, chargebacks, reporting errors, legal requirements, or third-party disputes. Third-party processing and reconciliation can affect timing. You are responsible for your taxes and accurate payout information.

The Services rely on third parties such as payment processors, AI providers, hosting providers, commerce platforms, merchants, affiliate networks, and analytics providers. Their services and links may be governed by separate terms and privacy policies. We do not control third-party products, content, policies, or availability, and failures or changes in those services may affect Brambles features.

Our Privacy Policy explains how Brambles handles personal information. You are responsible for using the Services with appropriate permissions and for providing notices required for your own users. We use reasonable safeguards designed to protect the Services, but no system is completely secure. Notify us promptly if you believe an account or credential has been compromised.

We may add, modify, suspend, or discontinue features and may impose reasonable limits to maintain security, reliability, legal compliance, or service quality. Beta or preview features may be less reliable and may change. We do not promise uninterrupted or error-free availability unless a separate written agreement includes a specific service level commitment.

We may update these Terms. If a change is material, we will post the revised Terms with a new “Last updated” date and provide any additional notice required by law. Continued use after updated Terms take effect means you accept them.

You may stop using the Services at any time and may cancel a subscription as described above. We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create a security or legal risk, or if a third-party dependency makes continued service impracticable. We will provide notice when reasonably possible.

On termination, your right to use the Services ends. Accrued payment obligations and provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnity, and general terms—remain in effect.

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Brambles disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that outputs, product information, revenue results, or third-party content will be accurate, complete, or available.

Nothing in these Terms limits rights or warranties that cannot lawfully be limited or excluded.

To the fullest extent permitted by law, Brambles and its directors, officers, employees, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising from or related to the Services.

To the fullest extent permitted by law, Brambles’ aggregate liability arising from or related to the Services will not exceed the amount you paid Brambles during the six months before the event giving rise to the claim or $1,000, whichever is less. These limits do not apply where applicable law does not permit them.

You agree to indemnify and hold Brambles harmless from third-party claims, damages, and reasonable costs arising from your Customer Content, your violation of these Terms or applicable law, or your infringement of another person’s rights.

These Terms are governed by California law, without regard to conflict-of-law rules. Before starting a formal legal claim, please contact us so the parties can try in good faith to resolve the issue. These Terms and any documents incorporated into them are the entire agreement about the Services unless you have a separate signed agreement with Brambles.

If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; Brambles may assign them in connection with a merger, acquisition, corporate reorganization, or sale of substantially all relevant assets. Electronic notices and signatures satisfy written-form requirements to the extent permitted by law.
